Dealer Terms

Summary: These terms set expectations for dealers listing on Bikes in Stock: listing accuracy, prohibited content, lead handling, compliance, and our rights to manage the platform.

1. Parties

These Dealer Terms apply to any dealer (“Dealer”, “you”, “your”) whose motorcycle listings appear on Bikes in Stock, operated by Creativity Sells Ltd (Company No. 05691082) (“we”, “us”, “our”).

2. Your listings and accuracy

You are responsible for the accuracy, completeness and legality of all listing content you supply or cause to be supplied, including (without limitation) price, specification, mileage, condition, imagery, promotional statements, and availability.

  • Listings must be promptly updated when a motorcycle is sold, reserved, or materially changed.
  • Pricing must be clear and not misleading.
  • Images and descriptions must fairly represent the vehicle.

3. Prohibited content and conduct

Dealers must not submit content that is:

  • false, misleading, or deceptive;
  • infringing third-party rights (including copyright);
  • unlawful, hateful, defamatory, or otherwise objectionable;
  • intended to manipulate search, tracking or platform behaviour in a harmful way.

4. Enquiries and lead handling

Where the Website forwards an enquiry to you, you are responsible for responding and managing that relationship. You agree to use enquiry data solely for handling the enquiry and associated sales communication, unless you have a lawful basis to use it for additional purposes (for example, explicit marketing consent).

5. Data protection

When you receive personal data from Bikes in Stock (for example, an enquiry), you will typically act as an independent data controller. You are responsible for compliance with UK GDPR, the Data Protection Act 2018, and PECR (where applicable), including providing your own privacy information to customers and handling data subject requests.

6. Permissions and rights to use content

You confirm you have all necessary rights, permissions and licences to provide listing content to us and to allow us to display it on Bikes in Stock and related channels. You grant us a non-exclusive, royalty-free licence to use, reproduce, display and distribute that content for the purpose of operating and promoting the marketplace.

7. Platform management rights

We may monitor listings for quality, compliance and marketplace integrity. We may remove, edit, suspend or de-prioritise listings (or dealer visibility) where we reasonably believe there is a breach of these Dealer Terms or where action is required to protect users, dealers, or the platform.

8. Availability and changes

We may change, suspend, or discontinue any part of the Website at any time. We aim to provide continuity, but we do not guarantee uninterrupted availability.

9. Limitation of liability

Nothing in these Dealer Terms limits or excludes liability where it would be unlawful to do so (including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).

Subject to the above, we will not be liable for any loss or damage arising from:

  • errors in Dealer-supplied content;
  • loss of enquiries due to factors outside our reasonable control;
  • website downtime, interruptions, or technical errors.

10. Changes to these Dealer Terms

We may update these Dealer Terms from time to time. Updated versions will be posted on this page and take effect when published.

11. Governing law

These Dealer Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
